§ 16-21. Operation and maintenance of food service establishments.

The operation and maintenance of food service establishments shall be according to
the rules and regulations of the Department of Human Resources Public Health, Chapter
290-5-14 Food Service, as adopted by the Georgia Department of Human Resources, said
rules and regulations being hereby incorporated into, and made a part of the Code
of Ordinances of Burke County, subject to the enforcement provisions herein. A "food
service establishment" as defined by the said rules and regulations is any establishment
for the preparation and serving of meals, lunches, short orders, sandwiches, frozen
desserts, or other edible products. The term includes: restaurants; coffee shops;
cafeterias; short. order cafes; luncheonettes; taverns; lunchrooms; places which manufacture,
wholesale, or retail sandwiches or salads; soda fountains; institutions, both public
and private; food carts; itinerant restaurants; industrial cafeterias; catering establishments;
food vending machines and vehicles and operations connected therewith; and similar
facilities by whatever name called. The term "food service establishment" shall not
mean a "food sales establishment," as defined in O.C.G.A. § 26-2-21, which does not
provide seating or facilities for consumption of food on the premises.
